N.L. Supreme Court justice orders new trial

The man was convicted in provincial court in Corner Brook on April 23, 2021 on two counts of sexually assaulting the girl between 2012 and 2020. The charges were for touching the girl for a sexual purpose and sexual assault. The man had been in a relationship with the girl’s mother from 2012 to 2017 and the three lived together for much of that time. The girl continued to spend time with the man after her mother and the man broke up.He appealed both his conviction and sentence, and the appeal was heard by Justice George Murphy in the Newfoundland and Labrador Supreme Court on April 19, 2022.
It was his determination that the misapprehensions of evidence and the resulting unreasonable findings of fact played an essential part in the reasoning process that resulted in the verdicts and warranted the quashing of the convictions.
