SC offers a partial solution to infra obstacles
THE Supreme Court has issued a directive that designates a number of regional trial courts as 'special expropriation courts' to handle expropriation cases concerning national railway projects. This is a significant step toward reducing one of the most common and contentious obstacles to infrastructure development, but the ruling as issued does not go far enough.
This is perhaps particularly true of railway projects, due to their size; the North-South Commuter Railway project, for instance, will have a total length of 147 kilometers, crossing five provinces, in addition to the entire breadth of Metro Manila. Thousands of property owners will be affected, and it would only take a few of them to reject expropriation to delay the entire project for years.
