The hearing, held on Friday, Jan. 31, 2025, at the Ombudsman ’s central office in Quezon City, aimed to clarify legal arguments and procedural details before a decision is made. Bercede attended in person, while Cortes appeared virtually.

The complainants alleged that Bercede allowed Cortes to function as mayor despite his suspension on Aug. 21. Labos and Miñoza argued in their complaint that Bercede committed grave misconduct and usurpation of authority for allowing Cortes to exercise authority during the interim.This move violated the suspension order and undermined the Ombudsman’s authority, according to the complaints.Bercede officially assumed office on Aug.
