Prior to this, the Ombudsman had already ordered Mabilog's dismissal for serious dishonesty related to allegations of his involvement in the illegal drug trade. Fearing for his life, Mabilog sought asylum in the United States. During a House of Representatives' quad committee hearing in September 2024, Mabilog claimed he fled to protect himself from the Duterte administration's attempts to implicate him in the drug trade.While abroad, the Court of Appeals reversed the Ombudsman's decision regarding the case concerning Mabilog's wealth. However, in March 2023, the Office of the Ombudsman filed graft charges against Mabilog and Nava before the Sandiganbayan for their alleged involvement in the towing contract. Subsequently, the Sandiganbayan 3rd Division and Lapu-Lapu City Regional Trial Court Branch 73 in Cebu ordered Mabilog's arrest. He was able to post bail and return to the Philippines. According to Bersamin, Marcos granted Mabilog executive clemency due to the circumstances that compelled the former mayor to leave the country, particularly the perceived threat to his life from the Duterte administration. Bersamin highlighted Mabilog's explanation regarding the alleged danger he faced, emphasizing that the truthfulness of these claims is no longer relevant. He stated that after Duterte's term ended and Marcos' administration took over, Mabilog felt more secure and returned to the Philippines, especially during the ongoing investigations by the quad committee. \The news of Mabilog's clemency has been met with mixed reactions.
