Subsequently, the Sandiganbayan 3rd Division and Lapu-Lapu City Regional Trial Court Branch 73 in Cebu ordered Mabilog's arrest. He was able to post bail and return to the Philippines. According to Bersamin, Marcos granted Mabilog executive clemency due to the circumstances that compelled the former mayor to leave the country, particularly the perceived threat to his life from the Duterte administration. Bersamin highlighted Mabilog's explanation regarding the alleged danger he faced, emphasizing that the truthfulness of these claims is no longer relevant.
