Magna Carta of Filipino Seafarers: Execution Bond Requirement Clarified

The National Conciliation and Mediation Board (NCMB) clarified the implementation of Section 59 of Republic Act No. 12021, which governs the execution and judgment of monetary awards for Filipino seafarers. This section requires seafarers to file a bond to cover potential reversal of awards by higher courts.

The execution and judgment of monetary awards under Section 59 of Republic Act No. 12021 or Magna Carta of Filipino Seafarers shall apply to complaints filed on or after the effectivity of the law.

The Department of Labor and Employment issued Department Order No. 247, series of 2025, that seeks to implement Section 59 of RA 12021, which prescribes rules on the enforcement and execution of decisions of the NLRC/NCMB. Upon finality of the decision of the NLRC or voluntary arbitrator, the undisputed amounts shall be immediately executory even pending appeal with the courts without the seafarer being required to file a bond.

“The general rule still holds that decisions of the NLRC and the voluntary arbitrators which have become final are still immediately executory even pending appeal with the courts,” he said. “The requirement of a seafarer’s bond is an exception to this general rule and applies only to disputed amount in the awards of the NLRC or voluntary arbitrator.”
