NEXT is a series of concerning subsections in Section 19 under Chapter IV .Subsection 19 provides that the State shall 'protect children from violence in State institutions and by State actors,' which includes 'residential homes.' Now, this is OK if real violence and abuse are happening within the homes against the child.
The reason for this is that Section 19 could possibly grant State authorities that morbid authority. The section provides that the State shall ensure that 'the child shall not be separated from their parents against their will, except when competent authorities determine, subject to judicial review, in accordance with applicable law and procedure, that such separation is necessary for the best interest of the child.
