A country club and golf course situated in Camp John Hay , Baguio City, has become entangled in a legal dispute between its owners and the Bases Conversion and Development Authority ( BCDA ). The BCDA , acting under the mandate of the local Regional Trial Court (RTC), is seeking to reclaim the valuable property, along with the assets of other sublessees operating within the privately owned Camp John Hay Development Corp.
\ The Baguio City RTC Branch 3 recently dismissed a petition for a temporary restraining order (TRO) filed by several sublessees of CJH Development Corp. (CJHDevCo). The court rejected the petition due to the applicants' inability to demonstrate that they were not involved in the arbitration proceedings and should be exempt from the government's efforts to regain full possession of the 247-hectare property in Camp John Hay. This decision follows a comparable denial by Baguio RTC Branch 79 concerning an earlier application submitted by a different group of foreign locators in Camp John Hay, who also sought similar relief. \ According to a court order issued on February 6th, the petitioners were deemed to have acquired their rights through subleases from CJHDevCo.
