THE Commission on Elections has come up with a resolution allowing warrantless arrest of individuals who were caught in the act of vote-buying and/or selling.The Comelec issued Resolution 11104, which aims to strengthen the government’s campaign against illegal vote-buying and selling.
The arrested person should then be brought to the nearest police station, while the recovered pieces of evidence, such as money or any other goods of value, sample ballots and other campaign materials used in the illegal activities, should be seized and taken into custody by the apprehending law enforcement officer and later be submitted to an investigating officer.The Comelec noted the need for a proper turnover and recording of the arrest and the seizing of the evidence.
