The ICC only steps in if: 1) A state is unwilling to prosecute genuinely. This may involve situations where the proceedings are conducted to shield someone from accountability or where there is an unjustified delay, and 2) A state is unable to prosecute. This can arise if the state's judicial system has collapsed, lacks the capacity, or is otherwise unable to carry out proceedings effectively.
