The Trump administration has transferred hundreds of immigrants to El Salvador , even as a federal judge issued a temporary order halting the deportations under an 18th-century wartime declaration targeting Venezuelan gang members. Officials confirmed the flights were in the air at the time of the ruling. U.S. District Judge James E. Boasberg issued the order on Saturday, temporarily blocking the deportations.
However, lawyers informed him that two planes carrying immigrants were already airborne – one bound for El Salvador and the other for Honduras. Boasberg verbally instructed the planes to turn around, but they seemingly did not comply, and he did not include the directive in his written order. White House press secretary Karoline Leavitt responded to speculation about the administration potentially disobeying court orders in a statement on Sunday. She stated that the administration did not disregard a court order. Leavitt argued that the order, which lacked legal basis, was issued after terrorists, specifically members of the Tren de Aragua gang, had already been removed from U.S. territory. The acronym refers to the gang that Trump specifically targeted in his unusual proclamation released on Saturday. In a court filing on Sunday, the Department of Justice, which has appealed Boasberg's decision, stated that it would refrain from using the Trump proclamation blocked by the judge for further deportations if his decision is not overturned. Salvadoran President Nayib Bukele, who agreed to house approximately 300 immigrants for a year at a cost of $6 million in his country's prisons, commented on the situation on the social media platform X. Bukele, whose post was shared by White House communications director Steven Cheung, remarked, “Oopsie…Too late,” alongside an article about Boasberg's ruling. Secretary of State Marco Rubio, who negotiated an earlier deal with Bukele to house immigrants, also posted on X, stating, “We sent over 250 alien enemy members of Tren de Aragua which El Salvador has agreed to hold in their very good jails at a fair price that will also save our taxpayer dollars.” Steve Vladeck, a professor at the Georgetown University Law Center, stated that while Boasberg's verbal directive to turn around the planes was not technically part of his final order, the Trump administration clearly violated the “spirit” of it. Vladeck added that this incident could encourage future courts to be highly specific in their orders, leaving no room for government interpretation
