THE Constitution clearly stipulates the fundamental policy of the state to respect private property rights.
The protection of property is declared as a fundamental principle of the State in Article II, Section 5, which reads: 'The maintenance of peace and order, the protection of life, liberty and property, and promotion of the general welfare are essential for the enjoyment by all the people of the blessings of democracy.
The crux of the issue is whether a violation of relevant environmental laws would rise to the level of being grounds to forfeit the property, or that the state can simply order the demolition of the buildings and infrastructures without taking away the land, and whether the owners are entitled to just compensation to cover the development costs, or that compensation is only available if the state will exercise its right to eminent domain and expropriate the land totally.
