The Supreme Court will hear on Oct. 21 the arguments on the petition seeking to hold the Dec. 5 barangay and SK elections as scheduled due to the alleged unconstitutionality of the law that paved the way for their postponement to Oct. 30 next year.

During their weekly meeting on Tuesday, the high court justices “immediately took action” on the petition filed by election lawyer Romulo Macalintal the day before to nullify Republic Act No. 11935. The law was passed by Congress on July 25 and signed by President Marcos on Oct. 10.
They gave Macalintal and Solicitor General Menardo Guevarra, representing the respondents—Malacañang and the Commission on Elections —only three days to prepare for the so-called oral arguments.The high court also required Malacañang and Comelec to submit their comment to the petition by noon on Friday, and set the oral arguments at 3 p.m. on the same day.
Macalintal had argued that while the Constitution gives Congress the power to fix the term of office of barangay officials, it did not authorize Congress to postpone the barangay elections or extend the term of village officials. INQ
