The Supreme Court has dismissed the petition filed by Makabayan bloc to nullify the presidential certification of the Maharlika Investment Fund as an urgent measure. | T2TupasINQ

SC explained it is important to provide concrete facts “to enable the Court to adjudicate the issues presented intelligently. In fact, by their own admission, the Senate has yet to act on the counterpart bill of HB 6608. To date, no law has been passed, and HB 6608 remains pending with the House for further revisions, eliminating petitioner legislators’ concerns regarding the expedited passage of HB 6608 in the House.

In seeking a reconsideration of the verdict, petitioners maintained the issues raised in their petition were already ripe for adjudication due to consummated acts of the respondents. They added they have thoroughly discussed in their petition that the issuance certification of calamity and emergency violated Section 26 of the Constitution because there is no calamity or emergency that warrants immediate enactment of the Maharlika bill.

In the main petition, they also urged SC to issue a guideline on when a bill can be certified as urgent because such a prerogative has been allegedly abused by several administrations.
