UPDATED AT 3:05 p.m.THE Supreme Court ruled en banc on Thursday that the Anti-Terrorism Act' or Republic Act 11749 is constitutional except for two provisions.In a media advisory, members of the High Court voted 10-3 in favor of giving credence to the position of the government.The Court cited some provisions, however, that were unconstitutional and ruled to 'partly grant ' the petitions on the basis of the ponencia of Justice Rosmari Carandang.
Under this provision a 'request for designation by other jurisdictions or supranational jurisdictions may be adopted by the ATC after determination that the proposed designee meets the criteria for designation of UNSCR 1373.'On the basis of the current petitions, all the other challenged provisions of RA 11479 are not unconstitutional,' the SC ruled.
