Sandiganbayan’s Fourth Division has denied the prosecution’s request to present testimonies of the Third Division’s witnesses for a different ill-gotten wealth case involving former president Ferdinand Marcos Sr.’s alleged cronies. | GabrielLaluINQ
The prosecution made this motion because some of the witnesses they want to present had either passed away, cannot be found, were unwilling, or were staying abroad.
If used as evidence, it would prevent the defendant’s counsel from cross-examining the testimonies as the witnesses cannot be presented physically. “It is in this light that the defendants understandably take issue on the curtailment, if not denial, of their right to cross-examine the said witnesses,” it added.
