Why is this problematic? During the Chretien era, the U.S. and Canada signed a safe third country agreement in 2004. This means that a migrant who enters one of the two countries must seek asylum there rather than crossing the border. The loophole, and it’s a big one, is that this agreement only applies to legal border crossings.
