Private complainant cannot question the grant of bail

Dear PAO,I am the private complainant in a criminal complaint filed against Jojo. After several hearings in the trial court, the presiding judge convicted Jojo. However, he appealed before the Court of Appeals and also filed a “Petition for Bail” pending appeal, which was granted by the Court. I want to question the grant of his petition for bail because I am afraid that he might flee and go into hiding, especially since he was already found guilty by the trial court.

”The rationale behind this pronouncement is that in a criminal case, the legal standing of a private complaint is limited only to being a witness. This is because in a criminal case, what was violated by the accused is the criminal laws of the State. Hence, the proper party to bring the said criminal case to court, and eventually question the decision regarding the criminal case, is the State. The participation of the private complainant in a criminal case is limited only to being a witness.
