Parents threaten legal action for TDSB error that excluded racialized, disabled and LGBTQ students from alternative school lottery

“It is difficult to overstate the injury caused to the dignity of students from under-represented communities whose immutable characteristics and identities have been used to disadvantage them,” according to a letter sent to the board on Wednesday afternoon by lawyer Shibil Siddiqi, who represents the group and is the father of an 11-year-old who was excluded.

“The TDSB is currently analyzing all the data associated with the application process across the 17 schools and on a school-by-school basis as we look to determine next steps and the appropriate restorative measures,” he said. “While this full analysis takes time, we are working to complete it as soon as possible as we know families are waiting for additional information.”— about a system error that prevented some applicants from under-represented communities from being fully considered.

“Direct discrimination is the only way to describe what occurred at the third stage,” reads the letter by Siddiqi. He goes on to say that prioritizing remaining spaces for applicants from under-represented communities “would further the harms already caused and cement the second-class treatment of students from under-represented communities by expecting them to settle for ‘leftovers.’”
