Sa 13-pahinang desisyon ng Thirteenth Division ng CA, nagpasya ang mga mahistrado na walang merito ang desisyon ng Ombudsman na nagkasala sina Chiong at Montalbo ng Grave Abuse of Authority, Misconduct, and Conduct Prejudicial to the Best Interest of the Service, dahil sa ginawang paglilipat sa mga kawani.
Nag-ugat ang reklamo laban kina Chiong mula sa “anonymous MIAA officials” dahil sa ginawa nitong reassignment sa 285 kawani sa loob ng wala pang isang taon sa puwesto ng opisyal bilang acting General Manager at Member of the Board of Directors ng MIAA. Naghain naman ng petisyon sa CA sina Chiong at Montalbo para ireklamo ang naging desisyon ng Ombudsman na nagpasya umano laban sa kanila kahit walang sapat na ebidensiya.
