SENATORS Bam Aquino, Risa Hontiveros, and Francis Pangilinan on Monday urged the Supreme Court to harmonize the conflicting provisions of the Constitution on judicial review and the exclusive powers of Congress.They made the appeal as they expressed their disagreement with the Supreme Court’s ruling that stopped the Senate from hearing the impeachment complaint filed against Vice President Sara Duterte.
They urged the Supreme Court to reconsider and apply two principles it has long upheld — the “Fairness Principle and the Doctrine of Operative Facts.”The Fairness Principle states that retroactive application of new legal interpretations should not harm those who relied in good faith on old ones.The Doctrine of Operative Facts mean that actions already taken under a prior, valid interpretation should be recognized as legally effective.
