Una nang sinabi ng SC na madalas mauwi ang red-tagging — na kinikillang porma ng harassment at pananakot — sa surveillance, panggigipit at minsa'y pati kamatayan. "The NTF-ELCAC and its functionaries have also repeatedly blocked all efforts to push for the enactment of proposed legislation criminalizing redtagging and protecting human rights defenders," sabi pa ng grupo.
Ayon sa Korte Suprema, ginagawa ng red-tagging ang isang tao bilang target ng vigilante, paramilitary groups o kahit mga ahente ng gobyerno. Dahil dito, madali aniyang matindihan kung bakit maaaring matakot para sa kanyang buhay ang mga nare-red tag.Ikinatuwa rin ng grupong PAMALAKAYA ang ruling ng SC patungkol haabang sinsang-ayunan ang mungkahi ng Karapatan na lusawin ang NTF-ELCAC.
