Mediation fails and a defamation trial awaits for Lachlan Murdoch and Crikey publisher Private Media, a court heard this morning.
Mr Murdoch is suing Private Media, Mr Beecher, Mr Hayward, Crikey editor-in-chief Peter Fray and political editor Bernard Keane over an article that linked the Murdoch family to the January 6 attacks on the Capitol in the United States.
He believes the article caused serious harm to his reputation by implying he “illegally conspired with Donald Trump to overturn the 2020 presidential election result” and “illegally conspired with Donald Trump to incite a mob with murderous intent to march on the Capitol”.The joinder of Mr Beecher and Mr Hayward arises from the same factual circumstances,” Ms Chrysanthou said.
Justice Michael Wigney noted the new statement, and other procedural decisions necessary to proceed with the case, mean there was “a possibility the existing trial date may need to be vacated”. It is still due to go to trial for about two weeks from March 27, 2023. Unless the issue of the new statement of claim and interrogatories – 181 questions Mr Murdoch’s team would like to put to Crikey – are resolved, the trial date “would in my view be entirely unproductive and manifest waste of the court’s time”, Justice Wigney added.is the media and marketing reporter at The Australian Financial Review.
