Ontario Labour Relations Board rules that GFL Environmental can terminate bargaining rights of a small group of unionized workers who joined company after sale of competitor
GFL Environmental Inc. has won permission to terminate the bargaining rights of a small group of unionized employees at the company’s Sault Ste. Marie facility.
The origins of the case date back to July 2021, when GFL purchased the assets of Waste Management, a local competitor that was headquartered at 120 Industrial Court A. The transaction made for an interesting workplace dynamic: the four unionized employees were reassigned to GFL’s Sackville Road facility, where they worked alongside 23 non-unionized staff already employed by the company.
Essentially, the case boiled down to one question: What happens when Company A buys Company B and there is an “intermingling” of old and new employees?
