When you look at the fine print of Secure Jobs, Better Pay Act one cannot help but think they are R by ambush that largely achieve the union’s industrial wish list, writes Paul O’Halloran.

As always, the devil is in the detail. There are 288 pages of detail. To understand the far-reaching implications its necessary to look at the fine print. Upon close examination, one cannot help but think that some aspects of these laws are IR by ambush.

Employers will not be able to ask their employees to vote on a multi-enterprise agreement even after prolonged bargaining with a union on the grounds of reaching an “impasse”, as is the case currently, without the consent of the unions involved. What they will do is open the door to more disputation and uncertainty for businesses at least in the short term, and keep industrial lawyers busy for the foreseeable future.
