The Department of Environment and Natural Resources (DENR) and the Department of Justice (DoJ) have raised concerns about the legality and constitutionality of the memorandum of agreement (MoA) between the late environment secretary Gina Lopez and the Masungi Georeserve Foundation Inc. (MGFI) regarding the management and protection of the Upper Marikina River Basin Protected Landscape.

THE Department of Environment and Natural Resources has been saying it all along, and it is no longer surprising that Environment Secretary Antonia Yulo-Loyzaga has openly articulated it in the Senate hearings. She even cited the opinion of the Department of Justice on the matter. At issue is the legality and constitutionality of the memorandum of agreement between the late environment secretary Gina Lopez and the Masungi Georeserve Foundation Inc.

While the Constitution is silent on the matter of natural resource protection, RA 7586 clearly stipulates the intent of the government to set aside and manage areas for environmental and natural resource protection.
