The Muntinlupa Regional Trial Court has partially granted Vic Sotto's petition for a Writ Of Habeas Data, ordering the removal of a controversial teaser video from 'The Rapists of Pepsi Paloma'. The court ruled that the video misused collected data and information by presenting a conversation between two deceased individuals.
MANILA, Philippines — Pauleen Luna-Sotto celebrated a partial victory on Monday after the Muntinlupa Regional Trial Court Branch 205 granted Vic Sotto 's petition for a Writ Of Habeas Data . Luna took to Instagram, sharing screenshots of the court's decision. The court ordered Darryl Ray Spyke B. Yap and anyone acting on his behalf, including the production team of Vin Centiments, to remove a 26-second teaser video from online platforms and social media.
The court deemed the video as having misused collected data and information by presenting a conversation between two deceased individuals, which could not be verified.However, the court allowed Yap to proceed with the production and eventual release of the film 'The Rapists of Pepsi Paloma,' which is scheduled to premiere in cinemas on February 5. The court stated that it could not suppress the entire film as it was based on the life story of Pepsi Paloma. Yap had secured consent from Paloma's mother and brother, drawing from public records like newspaper clippings, footages, and citing artistic freedom and public interest as justifications.Sotto had filed a Writ Of Habeas Data and 19 counts of cyber libel against Yap concerning the teaser. The teaser features young actress Rhed Bustamante, playing Delia Dueñas Smith (Pepsi Paloma), and Gina Alajar, portraying Charito Solis, in an emotional conversation. In the scene, Solis asks Paloma if she was raped by Vic Sotto, to which Paloma replies affirmatively. Luna-Sotto expressed her gratitude on Instagram, stating, 'The results are in and the outcome is in our favor, confirming that the material released was malicious in nature. We won! This victory is for our children and family, and we humbly lift our gratitude to Almighty God.' Meanwhile, Yap thanked his supporters on Facebook, stating, 'Because of your prayers and unwavering support, we consider it important news that we have received legal approval for the release of our film.' He added that their next step is to submit the movie for review to the Movie and Television Review and Classification Board, emphasizing their commitment to complying with all standards.
