Convicted US Marine Lance Corporal Joseph Scott Pemberton is set to get out of jail soon as the Bureau of Corrections confirms receipt of the court release order.

The Laude family appealed the court decision on Wednesday, arguing that Pemberton should not enjoy early release without proof of his behavior or participation in rehabilitation activities while in jail.

It remains unclear if Pemberton has been released but the Laudes’ lawyer, Virgie Suarez, said it would be easy for authorities to do so, that is why an appeal was filed Wednesday morning. The Armed Forces explained that although it provided the detention facility for Pemberton, the BuCor retains management and administration of all convicted detainees.
