Presiding Judge Gener M. Gito of Muntinlupa City Regional Trial Court Branch 206 issued the warrants of arrest. The murder complaints against Bantag and his co-accused before the DoJ were jointly filed in November 2022 by the National Bureau of Investigation and the Philippine National Police following a thorough investigation on the twin killings of Lapid and Villamor. The DoJ wrapped up its preliminary investigation into the murder complaints last February.

Among those presented as evidence was the dying declaration of Villamor wherein he identified the personalities that ordered the hit on the broadcaster, including the leaders of the three major gangs inside the national prison facility. The dying declaration was culled from the cellphone of Villamor's sister, Marissa. Said messages were sent by Villamor to his sister prior to his death with specific instructions to reveal them after his death.
