The trial was held in Sydney over seven days between October 2021, March 2022, May 2022 and November 2022. A decision by Justice Patrick Murray was issued in February 2023 and was released this week. “Where the Crown has particularized the indictment to include a specific period, a failure to prove it may be material in proving the offence or may be material where the accused defence would be prejudiced,” said the judge.

The complainant alleged that on two occasions, Burns touched her vagina once with his hand and once with his tongue. She said the incidents occurred at home owned by the accused. He said there were numerous cases where date amendments have been permitted but that depends on the circumstances of each individual case. The Crown’s bid to change the offence dates in this case came after the defence had cross-examined the complainant.
