In a case with implications for all states, two electric vehicle owners have taken the Victorian government to the High Court over a road usage tax.

, which is being justified as a way of ensuring all vehicle owners contribute to road construction and maintenance. However, South Australia has repealed a similar tax.In submissions filed before the hearing, the Commonwealth said the ZLEV charge fell “selectively” on the use of EVs.

“First, the ZLEV charge is not imposed during the production process or at the point of sale, but on the user of the ZLEV substantially after the point of sale. “Third, the amount payable is calculated not by reference to the value of the ZLEV, but by reference to the distance driven on ‘specified roads’. No charge will be payable in respect of a given year if a ZLEV is not driven on ‘specified roads’ during that period.”However, the submission of Mr Vandertsock and Ms Davies said the tax did “no more than introduce an ‘unreal distinction’ between use of ZLEVs on ‘specified roads’ and other use”.
