A memorial to Daniel Pellerin was set up near the parking lot of Farrell Hall in Dartmouth, where he was fatally stabbed and beaten by two people on the night of Aug. 29, 2014. - Tim KrochakThe Nova Scotia Court of Appeal has dismissed a Dartmouth man’s appeal of his conviction for second-degree murder in the 2014 stabbing of Daniel Pellerin.
Pellerin, 28, had two young daughters. He died after he was assaulted by two males in the parking lot of Farrell Hall in north-end Dartmouth on the night of Aug. 29, 2014. He claimed the verdicts were tainted by errors in the judge’s jury instructions and were unreasonable because they were inconsistent. He also argued the evidence did not support a finding of the intent required for second-degree murder.
The teenager was one of three youths who assaulted a boy related to Pellerin in the spring of 2014. Pellerin had confronted one of the boys a few days before the killing and slapped him on the head.
