TOLEDO CITY, Cebu — Several officials and personnel of the Mandaue City government are facing graft charges after the Office of the Ombudsman found probable cause to indict them for their alleged involvement in the demolition and padlocking of a disputed property in Barangay Paknaan.
In a resolution dated July 9, 2024, Graft Investigation and Prosecution Officer 2 Carl Vincent Sasuman said that 27 respondents and 24 unidentified individuals should be charged in court for violating Section 3 of Republic Act 3019 .Case backgroundThe complaint was filed by Maria Priscilla 'Happy' Melendres and Maritoni Melendres, who alleged that city officials and personnel forcibly entered their fenced property on May 3, 2023, using an undated notice to demolish.
Now they should suffer the consequences of their own acts and face possible jail time, the complainants added.Respondents' defenseIn their joint counter-affidavit, the respondents denied detaining the complainants and insisted that their actions were legally justified.They asserted that the property in question was public land and that the Melendres family lacked fencing and building permits.
