The impression has been created that they\u0027re \u0027sneaking\u0027 into Canada. But the government has itself, and a bad deal with the U.S., to blame.
The Canada-U.S. border stretches almost 9,000 km and it is an absurdity to imagine closing and monitoring the full length against the arrival of asylum-seekers. It was the impossibility of such monitoring that led to the STCA only applying at official land ports of entry in the first place.
Rather than renegotiating the STCA, we agree with — and are among — the refugee advocates, academics and constitutional lawyers who have long called for the suspension of the STCA. This very question isright now. Suspending the STCA would allow people to present themselves at our official ports of entry, rather than trying to cross at places such as Roxham. We are expertly equipped to process the movement of people at our official ports of entry.
Suspending the STCA would also allow Canada to live up to our international legal obligations to permit people to make a refugee claim when they arrive.to make a refugee claim. The makeshift nature of the Roxham Road crossing has contributed to a sense that people are sneaking into Canada, engaging in smuggling or trafficking, moving for nefarious reasons.
The fact that U.S. border agents are now allegedly involved in transporting people to this informal border point — actions governments around the world decry as the work of “smugglers” and “traffickers” — should raise questions about why the means people use to get to a border are assumed to be threatening.
We agree that the Roxham Road processing centre can and should be closed, but not because we think our borders should be closed to migrants. People will move. People have the right in Canadian and international law to claim refugee protection. How the government chooses to manage this reality at our border will tell us how serious they are about protecting people’s right to life and security of the person. We call on the Government of Canada to suspend the STCA.
