Despite participating in a scheme aimed at avoiding immigration rules and getting permanent residency status in Canada, a Korean woman has been awarded more than $300,000 in damages.
The trial heard that Kim wanted to immigrate to Canada with her young children and get away from an abusive husband. One way to enhance her application for residency was to show that she had a specialized skill that was needed by an existing Canadian business. Kim argued at trial that she was fooled into paying the large sums of money to support the restaurant with the anticipation of permanent residency and that Choi spent the money for her personal gain. But court also heard that Kim had been deceitful in her work resume and that her claims about her work history and work skills were untruthful, revealing an intention to mislead immigration authorities.
“It was obvious to Ms. Choi that Ms. Kim was vulnerable,” said the judge. “What may have started out as an arrangement to benefit both parties quickly turned into a predatory scheme to extract money on the pretext that it was necessary to keep the restaurant functioning. I conclude that Ms. Choi took advantage of Ms. Kim’s lack of business knowledge and simply pocketed sums of money that were not required for the business.
