Talia Neveah Forrest, 10, of Sydney Mines, was riding her bicycle along the Black Rock Road in Victoria County when she was struck by a vehicle and killed on July 11, 2019. CONTRIBUTEDHALIFAX — The Nova Scotia Court of Appeal has ruled that the decision to acquit a Cape Breton man in the driving death of a 10-year-old girl was legally flawed.
The panel heard the appeal, filed by the Crown, in January and after arguments, delivered an oral decision ordering a new trial be held. The written reasons for the decision were released Wednesday.In March 2022, Supreme Court Justice Mona Lynch issued an acquittal on three charges filed against Colin Hugh Tweedie.
The accident occurred shortly before 9:45 p.m. as Forrest and a friend were out for a bicycle ride along Black Rock Road, Victoria County. Tweedie was driving a Nissan Xterra at the time of the crash. He said the trial judge also erred in not addressing Tweedie’s blood/alcohol concentration within the two-hour period after he stopped driving.
Although he did not testify at trial, Tweedie told police he thought he hit a deer. He made no attempt at the time of the accident to determine exactly what he hit. “I am satisfied that the failure of the trial judge to not consider the question of wilful blindness could reasonably be thought to have impacted her decision to acquit Mr. Tweedie. I would allow this ground of appeal.”
