Two prominent members of last year\u0027s convoy protest have won the right to new change of venue hearings.

Hillier’s defence lawyer, David Anber, said his client will reapply for a change of venue.

Anber has argued Hillier needs to have his case heard outside Ottawa in order for him to receive a fair trial since the then MPP was a high-profile convoy supporter who was widely demonized for his actions. Hillier faces two counts of mischief, two of counselling to commit mischief, one of counselling someone to commit an indictable offence, three counts of resisting or obstructing a public or peace officer, and one of assaulting a public or peace officer.Article content

In his initial decision dismissing King’s change of venue application, Phillips said the same legal arguments King put forward had already been heard and rejected by a judge in the case of fellow protest organizer James Bauder.But the Supreme Court decision in R. v. Haevischer, Phillips said, rendered that decision inappropriate, and he invited King’s lawyer to set a new date for a new change of venue application to be heard by another judge.
