Final hurdle in Maynard case explained as ‘injustice’ storm brews over AFL decision
But there’s still one final hurdle to clear — a possible AFL appeal.
Some have suggested this could be something of a watershed moment for the league given the focus and sensitivities around concussion, even though the tribunal already gave Maynard the benefit of the doubt. The key is whether they think it simply deserved a proper hearing, or if they genuinely believe it warranted suspension.
It’s ultimately a small price for the AFL to play, and given the wider legal ramifications, whether the AFL can afford to not challenge the ban. “It would be, I think, a little bit of an injustice, because if it went the other way, I’m sure Collingwood would be appealing it,” Hamish Brayshaw said on SEN’s“I’m not over the ins and outs of the tribunal, but you leave the ground to make contact with the face and knock someone out, that’s been the way it’s been.“There’s been a lot of people saying it’s going to set a precedent and it’s divided a lot of people.
In other words, this was a football act and there’s unfortunately still scope for accidents to happen in such instances. Pies lawyer Ben Ihle argued Maynard’s leap was more vertical than horizontal and Brayshaw’s move to his right contributed to significantly to the impact. Even the club’s official social media post that announced Maynard had been cleared included the line: “Our thoughts remain with Angus Brayshaw and his family — we wish him a speedy and complete recovery.”
