In 2010, he claimed that “with a bigger and stronger Greenbelt, in another five years Ontario could be celebrating the permanent protection of entire ecosystems, the reduction of aggregate mining and damaging infrastructure on Greenbelt lands, and a robust farming community that is supported by favourable policies.”

The Greenbelt Act was created in a matter of months following the election of the McGuinty Liberals in October 2003. The Greenbelt was mentioned as a campaign promise and noted with one sentence in the speech from the throne on Nov. 20, 2003. One month later a zoning order had been issued and by June of 2004 a Greenbelt Protection Act had been passed and in early 2005 the property-rights-destroying Greenbelt Act was passed.

The losses appear to have grown substantially over the years, giving new credibility to the Deaton research. The provincial auditor general’s report contains data showing that the properties that the Ford government planned to remove from the Greenbelt carried an assessed market value of $240 million. Once removed from the Greenbelt and put in the hands of developers, the value would jump to $8.5 billion.

Such destruction of property values should be the target of legal challenges, but property rights are not a thing under Canada’s Constitution and the courts have thrown out attempts by developers to reverse aspects of the zoning rules. When Ontario developer Silvio De Gasperis tried to overturn the government’s refusal to allow a land deal back in 2005, the courts produced a sarcastic.
