A Sydney mum who killed her eight-week-old baby girl will not be jailed because she is not criminally responsible for the act due to mental impairment at the time, a court has found. 7NEWS
“Whilst the accused likely knew the nature and quality of her act, she did not know that the act was wrong because of a mental health impairment she suffered at that time,” Wilson said in her judgement.Later that year, her baby girl was born.
On February 1, the day before the death, the woman and her husband went to see a GP who noted she had “symptoms of depression, with some test results raising concerns of self-harm or risk to ,” court documents show.“She said she loved her baby and would never hurt her.” The next day, the husband left the home to take an older child to school. When he returned, he found the baby girl floating face down in the bathtub.The baby was taken to hospital but declared dead shortly after.
