In acquitting Krysta Grimes, N.L. Supreme Court Justice Vikas Khaladkar noted he found consistencies in the complainant’s details during the trial that were too important to ignore.

“A youthful witness might be excused for not knowing the location or timing of a sexual , however, a youthful witness should be able to give reasonably clear details about what happened,” the judge said. “The complainant is not an overly youthful witness. He should be expected to have a reasonably good recollection of the events complained of.
He said he and Grimes never made plans to meet again after that but had continued messaging until one morning the next December, when Grimes texted to ask if he had heard from his parents or the school about their relationship. They deleted each other as social media contacts and wiped their text messages from their phones after that, and most messages between the two were not recovered.
Khaladkar pointed to inconsistencies in the complainant’s evidence and differences between his statements to police and his testimony in court. He had initially denied anything had occurred with Grimes, the judge noted, and had told police their contact spanned Snapchat, text messages and phone calls until confronted with phone records which did not corroborate that evidence. The complainant testified his contact with Grimes had mainly been through SnapChat, where messages are not recoverable.
“If he saw the tattoos in real life, which he told police he did, he should have been able to identify that they are on her right leg,” the judge said.
