A 67-year-old man was ordered to enter his defence on a charge of committing physical sexual harassment against a minor.

Sessions Court Judge Elsie Primus made the order for Nasib @ Mohd Yusof Ismail after ruling that the prosecution had established a prima facie case against him Friday. The court fixed April 28 this year for Nasib’s defence. Nasib is accused of committing the offence by touching the seven-year and 11-month-old girl’s private parts between Oct 20 and 21, 2020 at 5am at a house in a village in Kota Belud.

The offence under Section 14 of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years, and whipping, on conviction. The prosecution had called five witnesses in the hearing during the prosecution stage. The court extended the bail of Nasib pending the disposal of his case. Deputy Public Prosecutor Tham Pou Jin conducted the prosecution while Nasib was not represented.
