The revelation of John Tory’s relationship with a former staffer has raised questions about the ethics of a workplace romance where a power imbalance is in play.

“It’s a very common story in workplaces. An older boss who has a lot of power and sway ends up in a situation where they spend a lot of concentrated time with a junior staff person and lines are crossed,” said Toronto lawyer Gillian Hnatiw, who is known for her practice in the areas of sexual assault, harassment and violence.
“As a matter of employment law, the mere fact of a relationship is not by itself inappropriate. It can lead to an inappropriate situation and it certainly can lead to a human rights, discrimination, harassment or other abuse of power situation,” said Daniel Lublin, founding partner of Whitten & Lublin Employment Lawyers.
“If someone has the power to impact your livelihood, can it really be said that you are in that relationship or staying in that relationship consensually?” asked Toronto employment lawyer Jon Pinkus.
