In dismissing the application, Muniandy said the power of transfer under section 417 of the Criminal Procedure Code should only be exercised only if it appears that not doing so may result in an unfair or impartial trial or otherwise appears expedient in the interest of justice. “If the decision on the case disfavours the applicant, she has the right to appeal against the High Court’s decision, pursuant to section 307 of the CPC.
Rewcastle-Brown, who is from the United Kingdom, was charged in absentia in September 2021 at the Kuala Terengganu magistrates’ court for criminal defamation under section 500 of the penal code, which carries a jail term of up to two years or a fine or both, if convicted.
