“Mr. Dery, wearing a Toronto Maple Leafs jersey with the name Belfour, and a black hoodie underneath, gets onto the platform and exchanges some words with the complainant,” she said. Defence counsel Adriano Iovinelli said although it wasn’t a defence to his client’s actions, Dery had been twice robbed in the downtown core and feared Trotchie might be doing the same thing.

Iovinelli said the time his client has spent on remand, which was difficult as the son of a police officer, was equal to nearly 19 months incarceration, and his client should be placed on probation for three years.
