Judge rejects class-action lawsuit in Lytton, B.C., wildfire, suggests amended claim
Chief Jordan Spinks of the Lytton-area Kanaka Bar Indian Band is the only remaining plaintiff in the claim after the death of fellow Lytton resident and plaintiff Chris O'Conner.
Hinkson writes that although the suit doesn't meet the criteria for a class-action case, he agrees it can be rewritten "with the benefit of reasons," and resubmitted. "In particular, I find that there are no clear material facts alleged as to how the defendants allegedly caused the wildfire," said Hinkson in the ruling posted online on Thursday.

The ruling identifies deficiencies in the current claim but suggests that it can be rewritten and resubmitted.

BC Supreme Court Rejects Class Action Lawsuit for Lytton WildfireThe BC Supreme Court has denied the certification of a class action lawsuit filed by Lytton residents affected by the 2021 wildfire. The lawsuit alleged that the fire was caused by trains passing through the village, with Canadian Pacific Railway and Canadian National Railway named as defendants. However, the court ruled that there was a lack of hard evidence linking the wildfire to the rail lines. The lawsuit's claims were deemed 'bound to fail' and the proposed class was found to be overbroad and vague.
