In a session with 12 senators present, the Philippine Senate voted to declare all positions vacant, removing Sen. Alan Peter Cayetano as Senate President. Sen. Sherwin Gatchalian was named acting Senate President after a quorum was declared based on Avelino v. Cuenco jurisprudence. The new majority bloc now has 12 members, while Cayetano's group is reduced to 10 senators.
"For clarity, Sen. Alan Peter Cayetano is no longer Senate President after the Senate , with 12 senators present and a quorum declared based on the recognized base number of 22 under Avelino v.
Cuenco, voted to declare all positions vacant, including the presidency of the institution," saad sa inilabas na pinagsamang pahayag ng mga kasapi ng majority bloc.
"Hindi pa lamang naihahalal si Senator Win Gatchalian bilang bagong Senate President dahil kailangan pa ng 13 boto sa ilalim ng Konstitusyon. Pero ito ang malinaw at mahalaga ngayon: bakante na ang lahat ng posisyon, tapos na ang dating liderato at dapat magpatuloy ang trabaho ng Senado para sa taumbayan," dagdag nila. Ang 12 senador ay binubuo nina: Senate President Pro-tempore Sherwin Gatchalian, Sens.
Vicente Sotto III, Juan Miguel Zubiri, Francis Pangilinan, Francis Escudero, Bam Aquino, Lito Lapid, brothers Erwin and Raffy Tulfo, Risa Hontiveros, Panfilo Lacson at JV Ejercito. Sa paglipat ni Escudero sa bagong mayorya, magiging 10 senador na lang ang grupo ni Cayetano na kinabibilangan nina: Pia Cayetano, Bong Co, Loren Legarda, Rodante Marcoleta, Imee Marcos, Joel Villanueva, Robin Padilla, Camille Villar, Mark Villar.
Hindi naman makakadalo sa sesyon ang dalawa pang kaalyado ni Cayetano na sina Jinggoy Estrada na nakadetine dahil sa kinakaharap na kasong katiwalian at pandarambong, at si Bato dela Rosa na nagtatago bunga ng arrest warrant na inilabas ng International Criminal Court. Sa naturang sesyon nitong Miyerkoles, inaprubahan ng 12 senador na italaga si Gatchalian na acting Senate President. Nitong nakaraang dalawang araw, nabigong makapagdaos ng sesyon ang Senado dahil sa pagliban ng grupong pinamumunuan ni Cayetano.
Gayunman, biglang dumalo si Escudero sa plenaryo ngayong Miyerkoles, na tumulong upang makamit ng bagong mayorya ang kinakailangang bilang para magkaroon ng quorum. Batay umano sa jurisprudence ng Korte Suprema sa kasong Avelino vs. Cuenco, sinabi ng bagong mayorya na mayroon silang quorum kung present sa plenaryo ang 12 miyembro.
"We're very fortunate that one of the members of the majority before -- Senator Chiz Escudero -- do not conform and believe in what they are fighting for," sabi ni Sen Erwin Tulfo sa mga mamamahayag sa media briefing matapos ang sesyon. Noong una, sinabi ni Tulfo na si Cayetano pa rin ang Senate President dahil bigo silang makakuha ng suporta ng ika-13 senador.
Pero kinalaunan, nilinaw niya na:"This is to clarify that due to the course of events leading to the formation of the new Senate Majority, the Senate Presidency is deemed vacant.
" Sa ilalim ng Senate Rule IV, Section 4, ang Senate President Pro Tempore ang gaganap sa kapangyarihan at tungkulin ng Senate President kapag ang Pangulo ng Senado ay"absent for one or more days. " —
