Court determines that an earlier judge’s decision to allow internet information as evidence was wrong and has granted the father the right as the only person allowed to discuss vaccinations with his children
The Ontario Superior Court of Justice has ruled that an Ontario judge was wrong to rely on internet-based misinformation that gave a mother decision-making authority for refusing to get COVID-19 vaccines for her two youngest children, aged 10 and 12. The case is referred to as J.N. and C.G., as the mother versus the father. Both are currently separated.
It was almost a year ago, on February 22, 2022 that the previous court ruled against the father and sided with the mother. The father had presented evidence from Health Canada and the Canadian Paediatric Society, which advocated for vaccinations for children. The judge in the first case found that the mother had “gone to extraordinary lengths to inform herself” and was satisfied that her sources were “qualified and reputable”.
The appeal court ruled that although people will argue about information on the internet, it cannot be accepted as admissible evidence unless it passes the following criteria:
