Carver wisely won’t comment on the ACCC’s past work – Sims’ decision was overturned by the Federal Court – but she does want to make it clear that her examination of 170 submissions, thousands of documents, reviews of the internal plans of TPG, Telstra and Optus, and interviews with executives from all interested parties, has shown that allowing the deal to go through would have a real impact on competition in the near, medium and long term.
The ACCC will have to make its case all over again, with Telstra and TPG immediately signalling they will take the decision to the competition tribunal. “This decision is a massive missed opportunity for the people, businesses and communities of regional Australia,” she said in a statement that echoed similar sentiments from TPG boss Inaki Berroeta.
