CSIS, the RCMP, CSE and Elections Canada work together during elections to bring information about potential interference to the panel’s attention, but it is up to the five panellists to decide whether the information should be made public. The panel is made up of the clerk of the privy council, the prime minister’s national security adviser and the deputy ministers of justice, public safety and foreign affairs.

Former Canadian Ambassador to China David Mulroney has said the threshold needs to be changed, because only informing the public when an election is at risk is an unreasonable standard. The 2006 federal election was rocked when then RCMP commissioner Giuliano Zaccardelli confirmed the force had opened an investigation into then Liberal finance minister Ralph Goodale over allegations of leaking budget information. No charges were ever laid, but the RCMP’s public complaints commission later ruled that likely influenced the campaign and should not have happened.

“There was no impact on the election as a consequence of any action by the panel. That it did not have to intervene was good news,” he said. “The threshold especially, required judgement, knowledge and context. The types of issues with which they might have to contend do not readily lend themselves to detailed, guiding metrics.”

Wernick said the system will have to be flexible. He said when it was created, Russia was the primary concern and still is a major one, but several countries and foreign interest groups try to influence Canada’s democracy.
