National Disability Insurance Scheme provider Katrina Chivell denies any wrongdoing, after allegations from a former client and two former workers that she overcharged the NDIS by roughly $300,000.

A former client and two former staff have provided evidence suggesting NDIS provider Katrina Chivell has overcharged the NDIS $300,000.The regulator is investigating the allegations against Ms Chivell, whose NDIS participant status was revoked in 2022.The CEO of Ark Allied Care says she has helped dozens of clients in Melbourne, regional Victoria and New South Wales.

But documents obtained by the ABC appear to show Ms Chivell's company charged the NDIS hundreds of thousands of dollars for services that were not being provided. The alleged lost money is just a fraction of the billions of dollars the NDIA says is being lost to overpayment every year."She has consistently acted within the guidelines and regulations set by the NDIS, ensuring that all transactions and services are compliant with their standards," Ms Chivell's lawyer said.Teresa Knight first met Ms Chivell through someone at her multiple sclerosis support group.

Ms Knight, who finds it difficult to keep track of her own NDIS funding, signed over control to TnC Care.At first, Ms Knight was allocated TnC Care employee Travis Hallam as her support coordinator and was happy with the services he helped arrange for her, including in-home support work, a physiotherapist and an occupational therapist.Ms Knight said her repeated calls to Ms Chivell went mostly unanswered and her allied health supports dropped off.

The vast majority of the $240,000 in charges were for providing a support worker to Ms Knight — separate to the services Ms Williams was providing. Ms Chivell did not make any comment on the hundreds of thousands of dollars that had been charged for a support worker.Mr Hallam said he saw several red flags while working for Ms Chivell at TnC Care.

Soon, Ms Chivell was paying thousands of dollars for things for Rebecca, including visa fees for her new partner. Soon after, she alleges Ms Chivell contacted her to let her know that the NDIS, via Plan Partners, was going to be paying money into her account from her NDIS funds and Rebecca should send it back to her.In texts seen by the ABC, Ms Chivell told Rebecca it would help cover the costs like the wedding and visa.

The NDIA wouldn't comment directly on the allegations, but said it had revoked Ms Chivell's participant status in June 2022. This happened one month after Rebecca made a complaint.Ms Chivell's lawyer said Rebecca did provide care services, including respite for Ms Chivell and her children during a separation from her husband.

Both Rebecca and Ms Knight said no-one from the NDIA or Plan Partners called them to check the payments. Criticism of the time taken to act on complaints about the NDIS have been revealed by the ABC and other media outlets multiple times, The NDIS Commission said since the establishment of the Fraud Fusion Taskforce in November 2022 it had executed 174 compliance actions against NDIS providers and individuals.The first piece of reform legislation is due to be considered by parliament next month, after initial opposition from the Coalition and the Greens.
